New Jersey Real Estate Commission Restrictions
Upon Brokerage Activities of Referral Agents
Referral agents are limited to the following activities N.J.A.C. 11:5-6.1O(a)1-2:
- Directing prospects to websites and other information sources on real estate that are generally available to the public
- Referring prospects for the sale, purchase, exchange, lease or rental of real estate to their broker or to another real estate licensee if authorized by the broker provided payment is continued to be made by the licensed broker to the referral agent
Referral agents can not engage in the following activities N.J.A.C. 11:5-6.1O(d)1-13:
- Negotiating the purchase, sale or exchange of real estate
- Leasing, renting or offering to lease or rent any interest in real estate
- Collective rent for the use of real estate or any other monies
- Negotiating commissions or compensation and otherwise negotiating or signing listing or buyer-brokerage agreements
- Negotiating or signing contracts for sale or lease of real estate
- Accepting the funds of others to be held by a broker, as escrow agent or as temporary custodian of funds of others in real estate transactions
- Conducting a private or public competitive sale of land or interest in land
- Negotiating, assisting or directing the closing of a transaction that may or results in the sale, exchange, lease rental or auctioning of real estate
- Negotiating, offering, attempting or agreeing to negotiate a loan secured by a mortgage or other encumbrance upon or transfer of real estate
- Conducting showings or open houses
- Participating in expos, marketing shows or other presentations where information on properties or real estate interests marketed through a promo plan is provided to the public
- Providing information on listings beyond the information referral agents are permitted to provide with respect to websites and other information sources
- Producing or presenting CMAs or similar studies of real estate
